Terms of service

These Terms of Service ("Terms") govern your access to and use of maai.lol (the "Site") and any purchase you make from MAAI ("MAAI," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

By using the Site, you represent that you are at least 18 years old, or that you are using the Site under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into these Terms.

2. Products and Pricing

We attempt to display our products, product images, descriptions, colors, sizing, availability, and pricing as accurately as possible. However, we do not warrant that all information on the Site will always be accurate, complete, current, or error-free.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time. If a material error affects an order you have already placed, we may contact you regarding the error and, where appropriate, provide the option to confirm the corrected order or cancel it.

All prices are listed in USD unless otherwise stated and are subject to change without notice.

3. Orders and Payment

Placing an order constitutes an offer to purchase the products included in your order. Receipt of an order confirmation does not necessarily constitute our acceptance of the order.

We reserve the right to refuse, cancel, or limit an order where reasonably necessary, including in cases involving suspected fraud, unauthorized payment activity, pricing or product errors, inventory issues, or violations of these Terms.

Payments are processed through Shopify and/or our designated third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your order.

We may limit or cancel quantities purchased per person, household, payment method, account, or order where reasonably necessary.

If we cancel an order after payment has been collected, any amount owed back to you will be returned through the applicable payment method in accordance with our policies.

4. Fraud and Order Verification

To protect MAAI and our customers from fraudulent or unauthorized transactions, we may review orders before fulfillment.

We may request additional information reasonably necessary to verify an order, payment method, billing information, shipping information, or customer identity.

We reserve the right to delay or cancel an order if we are unable to reasonably verify the transaction or believe that the transaction may be fraudulent or unauthorized.

5. Shipping 

Orders are subject to our separate Shipping Policy available on the Site.

Shipping methods, charges, processing information, tracking availability, delivery estimates, international shipping information, address responsibilities, and procedures relating to delayed, missing, returned, or undeliverable shipments are described in that policy.

Shipping and delivery estimates are not guaranteed unless expressly stated otherwise.

6. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, cancellations, and related eligibility requirements are governed by our separate Refund Policy available on the Site.

The Refund Policy is incorporated into these Terms by reference. Please review it before placing an order.

Nothing in these Terms or our Refund Policy limits any rights or remedies that cannot legally be excluded under applicable law.

7. Customer Information

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for transactions made through the Site.

You are responsible for errors or delays resulting from inaccurate or incomplete information you provide, subject to applicable law.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

8. Intellectual Property

All content on the Site, including the MAAI name, logos, graphics, photography, artwork, product designs, text, and overall visual identity, is owned by MAAI or used with permission and may be protected by applicable copyright, trademark, and other intellectual property laws.

Except as permitted by law, you may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from Site content without prior written permission from MAAI or the applicable rights holder.

9. Prohibited Use

You agree not to use the Site to:

  • violate applicable law or regulation;

  • infringe the intellectual property or other legal rights of MAAI or any third party;

  • engage in fraudulent, deceptive, abusive, or unlawful activity;

  • submit false or unauthorized payment information;

  • attempt to gain unauthorized access to the Site, customer accounts, systems, or networks;

  • introduce malicious code or otherwise interfere with the operation or security of the Site;

  • use automated systems, bots, or scrapers to access the Site for unauthorized commercial purposes; or

  • misrepresent the origin or authenticity of MAAI products.

We may restrict or terminate access to the Site where reasonably necessary to protect MAAI, our customers, or third parties or to enforce these Terms.

10. Third-Party Services

The Site is operated using Shopify and may integrate with payment processors, shipping carriers, analytics providers, marketing services, and other third-party services.

We do not control independent third-party services and are not responsible for their separate websites, policies, availability, security practices, or conduct.

Your use of third-party services may also be governed by their respective terms and policies.

11. Privacy

Our collection, use, and disclosure of personal information is described in our Privacy Policy available on the Site.

By using the Site, you acknowledge that you have had the opportunity to review our Privacy Policy.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis.

We do not guarantee that the Site will always be uninterrupted, secure, error-free, or available.

Any warranties that cannot legally be excluded or limited remain unaffected.

13. Limitation of Liability

To the fullest extent permitted by applicable law, MAAI and its owners, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Site or purchase of products through the Site.

To the fullest extent permitted by applicable law, MAAI's aggregate liability for a claim relating to a particular purchase will not exceed the amount paid to MAAI for the product or order giving rise to that claim.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless MAAI and its owners, employees, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Site, your material violation of these Terms, or your violation of the rights of a third party.

15. Governing Law

These Terms will be governed by the laws applicable to MAAI's business operations, without giving effect to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Nothing in these Terms is intended to deprive a consumer of protections that cannot legally be waived under applicable law.

16. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will remain in effect.

17. Changes to These Terms

We may update these Terms periodically to reflect changes to our business, the Site, our practices, or applicable requirements.

The updated Terms will be posted on the Site with a revised "Last updated" date. Changes apply prospectively except where otherwise required by law.

18. Entire Agreement

These Terms, together with the policies expressly incorporated into them, constitute the agreement between you and MAAI concerning your use of the Site and purchases made through it, except where additional terms are expressly provided.
